Shivnarayan alias Shiv Jairaj Singh (29) raped the girl on June 24, 2021, on the terrace of an under-construction building in Adajan. The court ordered the authorities to pay Rs 6 lakh to the rape victim under the government’s compensation scheme.
As per the case, Shivnarine worked as a security guard and lived in the SMC Bus Depot security cabin in Adajan. He also stayed in the security room of the Orchid Blossom building in Adajan.
The girl and her family lived in a slum near the Orchid Blossom building. On the day of the incident, in the afternoon, Shivnarayan lured the girl with biscuits and took her to the terrace of the D wing of the under-construction building Orchid Blossom. He kept her in a cabin on the terrace and raped her. After the rape, Shivnarayan attacked her, leaving her seriously injured. After this, he left the girl there in critical condition.
When the girl’s father, a mason, returned from work in the evening, his wife told him about the missing child. They informed the police who checked the CCTV footage in which Shivnarayan was seen taking the child to the terrace. Police found the girl on the terrace in a critical condition with injury marks on her private parts. Police caught Shivnarayan and registered FIR under various sections of IPC POCSO Act,
During the hearing of the case, Public Prosecutor D.V. Dave demanded strictest punishment to set an example in the society. But the defense counsel urged the court to impose a lesser sentence as the accused was married and had an eight-year-old daughter to look after.
After hearing the arguments of both the sides, the court said that the accused has a responsibility to keep others safe and also has an eight-year-old daughter. “Considering his criminal mind, his act cannot be taken lightly,” the court said.
The court sentenced him to life imprisonment till death under Section 376 (AB) of the IPC as well as sections of the POCSO Act.
