The High Court had given its verdict regarding the carbon dating of the alleged Shivling found on May 16, 2022 in Vujukhana of Gyanvapi.

The Supreme Court has stayed the order for scientific survey and carbon dating of the alleged Shivling found in the Gyanvapi Mosque in Varanasi. Staying the decision of the Allahabad High Court, the court said – there is a need to be careful in this matter. The order of the High Court has to be examined closely.

The Muslim side had filed a petition in the Supreme Court against the decision of the High Court. The petition was filed by advocate Huzefa Ahmadi on behalf of the Gyanvapi Masjid Management Committee. A bench of Chief Justice DY Chandrachud, Justice PS Narasimha and KV Vishwanathan heard it. The Hindu side has already filed a caveat in the Supreme Court.

On May 12, the Allahabad High Court had ordered carbon dating and scientific survey of the alleged Shivling found in Gyanvapi’s Vujukhana. The High Court had said how would this happen? The Varanasi court will take a decision on this. This work will be done under his supervision.

Next hearing will be on August 7
On behalf of the Hindu side, advocate Vishnu Shankar Jain said that before the court passes an order, the report of the ASI survey should be called for and considered once. On this, the court said that we will also see the report of the ASI. CJI said that first we will see the situation. We have to deal with this matter very carefully.

Huzaifa Ahmadi, the lawyer for the mosque committee, praised the judge and said he was really understanding of the situation. The Supreme Court will next hear the matter on August 7. The Supreme Court said that the order of carbon dating by the Allahabad High Court will not be implemented till the next hearing. UP and Central government government will have to file their reply on carbon dating.

3 major decisions of the courts on the alleged Shivling

  • October 14, 2022: The Varanasi District Court rejected the petition of the Hindu side seeking scientific investigation of the alleged Shivling on the grounds that scientific investigation would damage the Shivling.
  • 17 April 2023: The Muslim side filed an application in the Supreme Court on the problem faced in Namaz. On this, the Supreme Court ordered the Varanasi District Magistrate to solve the problem. Before Eid, arrangements were made for mobile toilets and tubs filled with water for Wudu within 100 meters of the Gyanvapi campus. However, the place where the alleged Shivling was found in the premises was kept sealed.
  • 12 May 2023: Allahabad High Court accepted the petition demanding carbon dating investigation and scientific survey of Shivling found during the survey. However, the date when the scientific investigation will happen was not told. Next hearing is after 3 days.

Hearing of three cases of Gyanvapi will now be held on May 22
Hearing of three cases related to Gyanvapi took place in Varanasi court on Friday. In the first case, hearing was held on the petition regarding scientific survey of Gyanvapi campus. In this, the Anjuman Arrangement Masjid Committee had to file objections, but no objection was filed.

The court has given the next date of hearing on May 22 in the matter. The second case was about hearing all the 7 cases of Gyanvapi together and fixing their schedule. In this, the court postponed the hearing. The next hearing of the case will be on May 22. At the same time, the third case was about choosing the successor of the Shringar Gauri case. In this too, the court has given the date of hearing on May 22.

The alleged Shivling was found on May 16
Let us tell that during the survey on May 16, 2022, the alleged Shivling was found in Gyanvapi. The Hindu side had earlier demanded its carbon dating and scientific survey in the Varanasi court. However, then the court rejected it. For the time being, when will carbon dating take place? Its date is yet to be decided. But this technique is being discussed from District Court, High Court to Supreme Court.

Now know what is the dispute?
The Hindu side claims that the 100 feet high Shivling found in the Gyanvapi complex is the self-manifested Jyotirlinga of Adi Vishweshwar. The Kashi Vishwanath Temple was built by Maharaja Vikramaditya about 2050 years ago, but the Mughal Emperor Aurangzeb demolished the temple in the year 1699. The claim states that the mosque was built after demolishing the temple on the land which is now known as Gyanvapi Masjid.

The petitioners have demanded that an archaeological survey of the Gyanvapi complex should be carried out to ascertain whether the underground portion is the remains of the temple or not. Along with breaking the floor of the disputed structure, it should also be ascertained whether the 100 feet high Jyotirlinga Swayambhu Vishweshwarnath is also present there or not.

The walls of the mosque should also be examined to find out whether they belong to the temple or not. The petitioner claims that the Gyanvapi mosque was built from the remains of the Kashi Vishwanath temple.
