Congress leader Surjewala challenges the law linking Aadhaar, Voter ID in Supreme Court; hearing tomorrow

The law linking Aadhaar and voter ID was challenged in the Supreme Court, with Congress’s Randeep Singh Surjewala seeking its repeal.

Seeking its repeal, the Congress leader, in a petition, termed the law as unconstitutional and a violation of the right to privacy and the right to equality.

The matter will be heard on Monday. A bench of Justice DY Chandrachud will hear the matter.

Center introduces bill to link voter ID card, Aadhar card

Earlier in December of 2021, the Center had introduced Election The Law (Amendment Bill) 2021 to link voter ID and Aadhaar card despite objections from opposition parties on the move. Law Minister Kiren Rijiju rejected the statements of opposition MPs that the bill would violate fundamental rights of citizens, clarified that the amendment was only to prevent bogus and bogus voting.

The government further said that the linking of Aadhaar with the electoral rolls would solve the “major problem” of multiple enrollments of the same person at different places and would go a long way in “cleaning up” the electoral rolls.

Opposition slams government

After the Bill was introduced, members of the Lok Sabha criticized the government for hurriedly bringing the Bill through the parliamentary process and demanded that it be referred to a Standing Committee. Congress leader Adhir Ranjan Chowdhury said, “The bill is outside the legislative competence of the House as it violates the limits of law laid down by the Supreme Court in its judgment (Puttaswamy v Union of India).” His party colleague Manish Tewari said, “Linking of voter ID and Aadhaar violates the fundamental right to privacy as defined in the Supreme Court judgment.”

They have also argued that allowing Aadhaar-Voter ID link could lead to more non-citizen turnout in the country.

Apart from the Congress, MK Stalin’s DMK, Sharad Pawar’s Nationalist Congress Party, Trinamool Congress, Shiv Sena and BSP have opposed the new laws.
