Shiv Sena (Uddhav Thackeray faction) MP Sunil Prabhu filed a petition on 23 June 2022 against the Maharashtra Assembly speaker.

The Supreme Court on Friday issued a notice to Maharashtra Assembly Speaker Rahul Narvekar. Shiv Sena (Uddhav Thackeray faction) MP Sunil Prabhu filed a petition against him on 23 June 2022.

In the petition, he sought a direction to the Maharashtra Assembly Speaker to take an early decision on the pending disqualification case against 16 rebel MLAs led by Eknath Shinde.

In fact, in June 2022, under the leadership of Shinde, the current Chief Minister of Maharashtra, several Shiv Sena MLAs broke away from the party and formed a government in the state with the BJP.

A bench of Chief Justice of India DY Chandrachud, Justices PS Narasimha and Manoj Mishra issued a notice in this regard to the office of the Speaker of the Legislative Assembly, asking it to respond within two weeks.

Advocate Devdutt Kamat, appearing for the petitioner, told the Supreme Court that the Speaker is deliberately delaying the petitions filed for disqualification of MLAs who have rebelled against the party.

Shinde told the allegation of disqualification was wrong
During the hearing last year, Eknath Shinde had said that the allegation of disqualification has been wrongly leveled against us. We are still Shiv Sainiks.

On the other hand, on behalf of the Uddhav Thackeray group in the Supreme Court, advocate Kapil Sibal had said that the MLAs who joined the Shinde group could avoid disqualification under the 10th Schedule of the Constitution only if they merged the breakaway group with another party. Last year, Eknath Shinde formed the government with 39 rebel MLAs from Shiv Sena.
In the month of June last year, Eknath Shinde raised the alarm of rebellion against the leadership of Uddhav Thackeray, due to which the Maha Vikas Aghadi (MVA) government fell. The MVA government consisted of the Shiv Sena, the Congress and the Nationalist Congress Party (NCP).

Shiv Sena split after Shinde’s rebellion. After which Eknath Shinde formed the government in Maharashtra with the support of 39 Shiv Sena MLAs (rebels) and himself became the Chief Minister and BJP leader Devendra Fadnavis became the Deputy Chief Minister.
