HC seeks evidence against Shahrukh Pathan, other accused in 2020 riots case

The Delhi High Court on Tuesday asked the police to furnish details of crimes committed by Shahrukh Pathan, who allegedly pointed a gun at a policeman and others during the 2020 northeast Delhi riots.

Hearing Mr Pathan’s bail plea, Justice Dinesh Kumar Sharma said, “The Special Public Prosecutor is directed to file a chart showing the role of the accused persons including the petitioner and the evidence given by them.”

Mr Pathan was arrested on March 3, 2020 from Shamli, Uttar Pradesh and has been in jail since then. He is accused of causing injury to police personnel and shooting a person in Jaffrabad on February 24, 2020.

During the hearing, Mr Pathan’s counsel said he has been in custody for more than three years.

The lawyer argued that the other accused in the case, who were also identified by the witnesses, have been released on bail, but his client is still in custody, though he is neither named in the FIR nor has anyone named him. Identified.

The lawyer said that there is a discrepancy in the statement of the victim who allegedly shot her.

The court fixed July 24 for further hearing of the matter.

Pathan approached the High Court after the trial court rejected his bail plea for the first time in December 2021.

The police had opposed the plea saying that he has a criminal family history and could adversely influence the witnesses.

He had said that he could endanger the safety of prosecution witnesses and abscond if granted bail, and even obstruct the process of investigation and destroy evidence.
