Hearing on Rahul Gandhi’s appeal to stay sentence today: Rahul gets bail from Surat Sessions Court in defamation case

Hearing on Rahul Gandhi’s plea seeking stay on conviction in criminal defamation case will be held in Surat’s sessions court on Thursday. In this case, the court issued a notice to the complainant Purnesh Modi and sought a reply by April 10. During this, it is not necessary for Rahul to be present in the court.

Earlier, on April 3, the court had granted interim bail to Rahul on a bond of Rs 15,000. Rahul had filed a main petition and two applications in the Surat court. Now understand what was the demand in these three applications and what was decided by the court.

Main Petition: The decision of the lower court was challenged. It will be heard on May 3.
First Application: In one, a stay was sought on the sentence. Accepting this, the court granted interim bail to Rahul. The court said that this bail will remain till the decision on this application.
Second Application: In this, a stay was sought on the conviction. On this, the court said that no order can be passed without hearing the other side. There has to be a hearing on this.

Was sentenced to two years in defamation case
On March 23, Rahul Gandhi was sentenced to two years in a defamation case. Shortly after the sentence was announced, he was granted bail for 30 days. His membership of the Lok Sabha was canceled the very next day after the sentence was pronounced. Rahul was an MP from Wayanad in Kerala.

Priyanka also reached Surat with Rahul

Before Rahul left for Surat from Delhi, Sonia Gandhi came to meet him at 10.30 am. After 1 hour, Rahul left for Surat in a chartered flight with sister Priyanka. The CMs of Rajasthan, Chhattisgarh and Himachal Pradesh also reached Surat. Rajasthan CM Ashok Gehlot also held a press conference before Rahul’s arrival. Gehlot said – We have faith in the judiciary. We have come here to show our unity. We are doing Satyagraha to save the country. The country is watching what is happening to Indira Gandhi’s grandson, Rahul Gandhi, son of Rajiv Gandhi.

Rijiju said – pressure is being created on the court
Union Law Minister Kiren Rijiju targeted the Congress. Rijiju said- When your (Rahul Gandhi) trial went on, then why didn’t you appeal. You are doing this drama after the court convicted you. This is only to create pressure on the court. The Congress party considers the whole family above the country.

March 23: Conviction in defamation case
Surat court sentenced Rahul to 2 years imprisonment on 23rd March. However, he got bail after 27 minutes. In 2019, he gave a statement regarding the Modi surname in the assembly of Karnataka. After this, Gujarat’s BJP MLA Purnesh Modi filed a defamation case against Rahul.

March 24: Parliament membership canceled
Congress leader Rahul Gandhi’s Parliament membership was canceled on March 24 at around 2.30 pm. The Supreme Court in a 2013 judgment had said that any MP or MLA found guilty by a lower court would be disqualified for membership of the Parliament or the Legislative Assembly.

March 27: Notice to vacate bungalow received
On March 27, the Lok Sabha Housing Committee sent a notice to Rahul to vacate the bungalow. The committee asked him to vacate the official residence at 12 Tughlaq Road by April 22. Rahul has decided to vacate the bungalow and stay in Sonia Gandhi’s residence. Their belongings have also shifted.
