Actress Jiah Khan, who was found dead at her residence in June 2013, was a victim of her emotions, says a Central Bureau of Investigation (CBI) court order copy, exclusively accessed by CNN-News18.

Last week, the court acquitted actor Sooraj Pancholi in Khan’s murder case. The order was pronounced nearly 10 years after Khan was found dead at his residence in June 2013.

The court has said in the copy of its order that it cannot be denied that the deceased Nafisa Khan alias Jia Khan had suicidal tendencies.

“No doubt, it is an unfortunate incident that a young girl has committed suicide. However, the evidence available on record shows that the deceased was a victim of her own emotions. She could not control her emotions. The deceased could always opt out of the relationship. However, she could not overcome her feelings and her love for the accused, for which the accused cannot be held responsible. It has come on record that at the relevant time, the accused was also pursuing a career in acting and admitted that he could not devote sufficient time to the deceased. However, earlier when the deceased attempted to commit suicide, the accused had saved her. He helped her to come out of depression.

The order passed by the court is critical of the stand taken by Khan’s mother Rabia to “liken this case as a murder”. The order also speaks about the petition filed in the Bombay High Court to transfer the case to national and international agencies.

who wrote the letter?

“Complainant Rabia Khan destroyed the entire case of the prosecution by giving contradictory evidence. The complainant suspects everyone except herself.

In fact, questions were also raised as to why the First Information Report (FIR) in the matter was filed six days later, with no mention of the reason for the delay.

The delay in handing over Khan’s suicide note to the agencies and its subsequent leak to the electronic media has also been questioned by the court.

The court questioned why the letter was handed over to the investigating officer only after getting it notarized.

As a part of the court hearing, it was mentioned that forensics indicated that the letter may not have been written by Khan. “The letter was handed over to the investigating officer after notarization, which raises serious doubts about the genuine authorship of the said letter,” the order said.

‘No evidence of murder’

The order states that Rabia, through her evidence, tried to show that Khan never committed suicide, but was killed by Pancholi. But the court, while pronouncing the order, had clearly said that there was not enough evidence against Pancholi in the abetment to suicide case, so he was acquitted.

“The complainant was the main and important witness of the prosecution, based on his complaint, the law was in motion. The complainant openly showed disbelief on the prosecution. When the prosecution’s case was that of suicide, the complainant said that it was a case of murder. However, there is no allegation of murder in this case.

The order also stated that Rabia had blamed both the investigating agencies (Mumbai Police and CBI) stating that both the investigating agencies had not conducted a proper and proper investigation.

The Court said that Rabia did not rely on the doctors’ opinion, post-mortem report or any kind of expert witness, due to which the “prosecution case was destroyed”.

As per the order, according to expert opinion, Khan was suicidal. “It is observed that after a long and thorough investigation, both the Investigating Officers concluded that it was a case of suicide… Though the complainant has stated it to be a murder case, the evidence available on record is contrary to what the complainant has stated. do not reflect,” the judge said in the order.
