A bench of Justices BR Gavai and Prashant Kumar Mishra will hear the petition of Rahul Gandhi in the Modi surname case in the Supreme Court today. On July 15, Rahul had filed a petition for urgent hearing of the case.

The court accepted on 18 July. Prior to him, BJP MLA Purnesh Modi, who had filed a case against Rahul, had also filed a caveat and appealed that a decision should not be taken in the case without hearing him.

Senior Advocate Abhishek Manu Singhvi will appear for Rahul Gandhi. If Rahul does not get relief from the Supreme Court, he will not be able to contest any election till 2031. The rule is that there is a ban on contesting elections for six years after the completion of the sentence. In this case, the sentence of 2 years and after that 6 years will be completed in 2031.

In the defamation case, on 23 March 2023, Surat’s sessions court sentenced Rahul Gandhi to 2 years. Rahul’s MP had gone after this decision.

Gujarat High Court had said – Punishment is justified
On July 7, Justice Hemant Prachhak of the Gujarat High Court had said, ‘There are at least 10 criminal cases pending against Rahul. Apart from this case, some other cases have been filed against him.

One has been filed by the grandson of Veer Savarkar. In any case, not stopping the punishment is not injustice. The punishment in this case is just and proper.

Rahul Gandhi is seeking a stay on the sentence on grounds that do not exist. There is no need to interfere in the decision of the Surat court. The petition is dismissed.
