BJP’s Rajya Sabha MP Sushil Kumar Modi has filed an application seeking cancellation of bail of Congress leader Rahul Gandhi and issuance of arrest warrant against him for non-appearance in the court.

Gandhi was to appear in the MP/MLA court in a defamation suit filed by BJP Rajya Sabha MP Sushil Kumar Modi over the senior leader’s alleged remarks on the Modi surname.

Special Judicial Magistrate Adi Dev had passed an order on March 18 asking Gandhi to appear before it on April 12. But the counsel for the former Congress president requested that he be given some more time to appear and record his statement.

While stressing on the valid reason for extension of time and exemption for the day, Dev inquired about the reasons for giving more time to the senior leader. Gandhi’s counsel said the entire team was preoccupied with the Surat case, in which Gandhi was sentenced to two years in jail and disqualified from the Lok Sabha.

Opposing this request, Modi’s counsel told the court that Gandhi had disobeyed the court order prolonging the proceedings of the case and therefore, his bail should be canceled and an arrest warrant issued. The former Deputy Chief Minister has filed an application in the court to issue an arrest warrant against the former Congress President for not appearing in the court.

Deo, while refusing to set April 29 as the next date of hearing, as requested by Gandhi’s counsel, allowed April 25 as the next date and asked Gandhi’s counsel to ensure her physical presence before the court. Said.

“Today, Rahul Gandhi was to appear in the court to record his statement under Section 313 of the Code of Criminal Procedure. But despite being ordered to appear physically twice, he did not do so today. Therefore, we have given an application stating that he has violated the order of the court and asked for cancellation of his bail bond and issue of arrest warrant to ensure his presence, on which his lawyer has next Took oath on the date, i.e. 25th April. A legal expert said that because Gandhi had appealed against the conviction in the Court of Appeal, there were two possibilities: if his conviction was not overturned, his disqualification as an MP would remain and he would be barred from contesting elections for eight years. and, if he is to have his conviction reversed, would not be prosecuted for defamation in other jurisdictions such as Patna under Article 20(2) which defines double jeopardy – “no person prosecuted and shall be punished for the same offense more than once”.

Addressing a gathering in Wayanad on Tuesday, Gandhi said, “MP is just a tag. This is a post, this is a post. BJP can take away the tag, post, house or they can put me in jail. But they cannot stop me from representing the people of Wayanad.”
