Muslim side’s application on Gyanvapi rejected by Allahabad High Court: challenged the case of right to regular worship of Shringar Gauri

The case of regular worship of Shringar Gauri in the Gyanvapi campus will continue in the Varanasi court. The Allahabad High Court on Wednesday dismissed the review petition of the mosque committee against the case. The district court of Varanasi has also rejected the petition of the Muslim side earlier.

Regular worship of Shringar Gauri was demanded by 5 Hindu women and petition was filed in Varanasi court. The Muslim side had filed an application against this in the High Court. On this, the single bench of Justice JJ Munir gave this decision. After the completion of the debate, the court had reserved the decision on 23 December 2022.

Hindu side’s lawyer Vishnu Shankar Jain said, “It is a very historic verdict, as the Muslim side always claimed that this case was barred by the Places of Worship Act fact. The Civil Court of Varanasi gave the verdict in our favor on 12 September The same thing has been said in the Allahabad High Court today by Justice JJ Munir, in which he held that the revision petition is not maintainable and dismissed the petition of the Anjuman Arrangement.

What did the High Court say on the petition of the Muslim side?
Allahabad High Court said- The Hindu side is demanding the right to worship Maa Shringar Gauri, Lord Ganesha and Lord Hanuman on the disputed property. Therefore the civil court has jurisdiction to decide the matter.

The High Court further said that the petitioner’s contention was that from August 15, 1947 to 1993, there was regular worship here. As the controversy escalated in 1993, permission was granted to worship once a year under the regulation of the state of Uttar Pradesh. Therefore, worship cannot be prohibited under the Places of Worship (Special Provisions) Act, 1991.

The Muslim side argued that worship would disturb the religious nature
Senior advocates SFA Naqvi, Zaheer Asgar, Fatima Anjum were present on behalf of the Muslim side during the hearing in the High Court. Advocates Harishankar Jain, Vishnu Jain, Pradeep Sharma, Saurabh Tiwari, Prabhash Pandey, Vineet Sankalp, Additional Advocate General MC Chaturvedi, Chief Permanent Advocate Bipin Bihari Pandey argued on behalf of the Hindu side.

Naqvi, counsel for the Muslim side, argued that regular worship was prohibited by the Places of Worship Act as worship would disturb the religious nature of the place, which cannot be done legally. That’s why regular worship should not be allowed here.

Hearing was held in September 2022
In this case, the district court of Varanasi gave a 26-page verdict on 12 September 2022. It was said that this case does not come under the Place of Worship Act, 1991.

Shringar Gauri is worshiped only once a year.
The right to daily worship of Shringar Gauri in Varanasi was a long standing demand. At present Shringar Gauri is worshiped only once in a year on the fourth day of Chaitra Navratri.

Earlier, the women litigants had said – Mother give us strength to visit the original place. Wished to Maa Shringar Gauri. Baba has been found. Just like Namaz is done in Gyanvapi, similarly we should also get the right to worship. In our case, a lot of evidence has been found in the proceedings of the commission. We are not disappointed. Have won the case of Places of Worship Act.

What is the case related to Gyanvapi-Shringar Gauri?
Five Hindu women had sought permission to worship Hindu deities present in the Gyanvapi mosque complex. These women especially wanted permission to worship Shringar Gauri every day. A survey was also done in the mosque on the orders of the court. After the survey, the Hindu side claimed that a Shivling is present in the basement of the mosque, while the Muslim side described it as a fountain.

On August 18, 2021, 5 women had reached the court seeking permission for daily worship of Maa Shringar Gauri, Ganesh ji, Hanuman ji and other deities present in the premises of Gyanvapi Masjid. At present, worship takes place here only once a year. These five petitioners are being led by Rakhi Singh from Delhi, the remaining four women are Sita Sahu, Manju Vyas, Lakshmi Devi and Rekha Pathak from Banaras.

On 26 April 2022, the Varanasi Civil Court had ordered videography and survey for verification of Shringar Gauri and other deities in the Gyanvapi Masjid premises.
