The Madurai Bench of the Madras High Court has directed the Tehsildar of Athur in Dindigul district to consider a representation made for removal of encroachment on a water body in Keelakottai village of Athur.
The court was hearing a plea filed by Dindigul district’s MC Pandi, who sought a direction to the authorities to remove encroachments made on the reservoir at Keelakottai village. The petitioner stated that the authorities did not consider his representation.
A division bench of Justice MS Ramesh and Justice PT Asha said that it is needless to point out that whenever such a representation is made to a statutory authority, the authority is duty bound to act on its own merits. consider and pass. Failure to consider the representation by the statutory authority would amount to dereliction of duty, the court directed the Tehsildar to consider the representation made and pass appropriate orders in three months.
