As pleaded, the appellant is the proprietor of the trademark in question, and the said marks belong to the Tata group are used across the board by almost all the companies. The eminence of the business reputation and popularity of the trademark of the Tata Group is beyond competition. There is sufficient pleadings in the plaint to reach the aforesaid conclusion.” The court said in the order.
