Top official says RERA has become functional in West Bengal. Kolkata News – Times of India

Kolkata: The West Bengal Real Estate Regulatory Authority (WBRERANearly 18 months after the Supreme Court struck down the state’s own rules introduced as an alternative to the central law, a senior official said.
In May last year, the apex court had declared the West Bengal Housing Industry Regulatory Act (WBHIRA) as “unconstitutional”.
“WBRERA is now in existence and we have started functioning recently. Till the time the IT backbone is ready, consumers will be able to physically lodge complaints against builders, agents and others. It is expected to be commissioned within a fortnight.” sandipan mukherjeewho took over as the chairman of WBRERA told PTI.
West Bengal was perhaps the only state where the Real Estate (Regulation and Development) Act, 2016 was passed. Parliamentwas not activated.
The WBRERA is headed by Mukherjee, a former Indian Forest Service officer, and has two other members – BN Das (former power department official) and Tapas Mukhopadhyay (former chief engineer of the PWD).
Mukherjee urged homebuyers not to deal with properties that are not registered with WBRERA.
“All projects, their promoters and agents must compulsorily be registered with the regulator. It has powers to book promoters and impose fines, but does not have police capabilities,” he explained.
Homebuyers Association FPCE Recently urged the West Bengal government to enact a real estate law Rare functional at the earliest in the State to protect the interests of the consumers.
The Supreme Court ruling came on a petition filed by the Forum for People’s Collective Efforts (FPCE), an umbrella body of homebuyers. FPCE has played an important role in the enactment and implementation of RERA.
FPCE President Abhay Upadhyay appealed to the state government to take steps to ensure a fully functional RERA to safeguard the interest of home buyers and bring accountability as well as transparency in the sector.
